Terms of Service

You must be at least 13 years old to use the Service. If you are under 18, you may use the Service only with the involvement and consent of a parent or legal guardian, and by creating an account or using the Service you represent that you have their permission. The Service is not available to anyone under 13.

Xotter helps you create and tailor resumes and evaluate job descriptions using artificial intelligence. The Service is an applicant-facing drafting and editing aid.

You are responsible for the accuracy of your account information, for keeping your credentials secure, and for all activity under your account. Notify us promptly of any unauthorized use.

You agree not to use the Service to: violate any law; submit false, fraudulent, or misleading credentials; infringe others' rights; harass or harm others; attempt to reverse-engineer, extract, or misuse the underlying AI models; scrape or bulk-extract data; or interfere with the security or operation of the Service.

You retain ownership of the resume content and other materials you submit ("Your Content"). You grant us a limited, non-exclusive license to host, store, process, transmit, and display Your Content solely to operate and provide the Service to you, including transmitting it to our AI subprocessor for processing. You are responsible for the accuracy and truthfulness of Your Content.

The Service, including its software, design, and content (other than Your Content), is owned by Xotter and protected by intellectual-property laws. We grant you a limited, revocable, non-transferable license to use the Service for its intended purpose.

The Service uses generative AI to produce drafts and assessments. AI-generated output may be inaccurate, incomplete, fabricated ("hallucinated"), or outdated. You are solely responsible for reviewing, verifying, and editing all AI-generated content before using it for any application or professional purpose. Output is not legal, career, recruiting, employment, financial, or other professional advice. Because generative AI models produce statistically similar outputs from similar inputs, AI-generated output may resemble output generated for other users; do not assume any output is unique to you. Your Content is transmitted to a third-party AI provider (Anthropic) for processing, subject to its terms; see our Privacy Policy.

Xotter does not guarantee any employment outcome, interview, callback, application response, applicant-tracking-system pass-through, salary, promotion, or other career result. Any job-fit assessments, scores, or recommendations are informational only and are not a hiring decision tool. You are solely responsible for the accuracy and truthfulness of any resume or application content you submit to employers. Xotter is not a staffing agency, employment agency, or recruiter, and is not designed for and may not be used by employers as an automated employment decision tool.

The Service is provided "AS IS" and "AS AVAILABLE," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

To the maximum extent permitted by law, Xotter will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or one hundred US dollars (US$100).

You agree to indemnify and hold harmless Xotter from claims, losses, and expenses arising out of Your Content or your violation of these Terms or applicable law.

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or for any lawful reason, with or without notice.

We may modify these Terms. If we make material changes, we will provide conspicuous notice through the Service and update the "Last updated" date, and where required we will ask you to review and accept the updated Terms before continuing to use the Service.

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction and venue of the state and federal courts located in Florida for any dispute not subject to other agreed dispute-resolution terms.

If any provision is held unenforceable, the remaining provisions remain in effect. These Terms, together with the Privacy Policy, are the entire agreement between you and Xotter regarding the Service. We are not liable for events beyond our reasonable control. We may provide notices to you electronically.
